Dryboy AB – PURCHASING TERMS AND CONDITIONS

PRICES

All prices stated on Dryboy AB’s online store include value added tax (VAT) of 25%. Shipping costs are extra and the amount is shown before you complete your order.

VAT and fees may be subject to change. Our product range and our prices may be adjusted from time to time. However, you can always be certain of the agreed price at the time of your order.

PAYMENT

We use Klarna and PayPal as partners for purchases made on Dryboy AB’s online store. This means your payments are secure, whether you pay by invoice, using your bank or credit card, or via your bank account. Dryboy AB never sees any information about your credit card number or bank account and all card and personal data transmitted via both Klarna and PayPal is encrypted.

DELIVERY:

Your product (cover) is delivered folded up in a specially made bag. As the cover has been folded, it can be expected to be creased. This is completely normal and the creases usually disappear after a short period of use.
We usually manufacture and deliver your product within approximately 2 weeks from receiving your order. You will receive an email from us once your product has been manufactured, checked by us and dispatched.

Most of the shipping of our products in Europe is provided by UPS. You will receive a message once your product has been sent to you.

RIGHT TO CANCEL

Since our products are produced (tailor-made) to your specific needs, your right to cancel is waived once the customisation of your order has started. Once you approve your order on the website and accept our General Terms and Conditions, you accept that the customisation is starting and your right to cancel is waived.

In the unlikely event that you change your mind after making an order, please contact us as soon as possible and we will do our best to cancel your order and stop production of your product. However, we cannot guarantee it will be possible to cancel your order as it depends on whether or not manufacturing of your product has started.

GUARANTEE

In addition to what is stipulated by the Consumer Contracts Act, Dryboy AB provides an extensive five-year guarantee on your product’s waterproofing from the purchase date of your product. Waterproofing refers to the ability of the fabric used to make your cover to resist the penetration of water such as rain, snow and dew. This extended guarantee applies as long as the cover is used for the purpose for which it is produced and is undamaged; i.e., has been treated with due care and diligence and not been subject to any external effect or accident that has damaged the fabric. This extended guarantee does not apply if the cover is used for any other purpose or is used incorrectly, including, for example, insufficient run-off leading to the formation of large pools of rainwater collecting for extended periods.


RIGHT OF COMPLAINT

As a consumer (private individual) you always have a statutory right of complaint which may be different depending in which country you reside. This means you can either request to have your goods repaired, exchanged, for the purchase to be cancelled or to receive a reduction on the price, depending on the circumstances. Right of complaint means that you as a customer can complain about faults and defects in a product purchased from Dryboy AB. The right to make a complaint, however, only applies provided that such faults and defects have not arisen as a result of incorrect or neglectful use of the product or the product being damaged in some other way through external effect, handling or accident after you received the product.


USING A GUARANTEE OR BRINGING A COMPLAINT

You must use your Guarantee or bring a complaint about your product within a reasonable period after you notice the defect. The first thing you should do is contact Dryboy AB by email, letter or telephone. The product should then be sent to Dryboy AB. Remember to save the receipt or consignment note for your purchase, as this acts as guarantee documentation.

What personal data do we collect and where do we collect it from?

When you contact us (e.g. when making a purchase, filling in a form or visiting our online store) we collect personal data about you. The data we collect may consist of name, social security number or identity document number (only where purchases are not made using Klarna or PayPal), address, email address and telephone number, purchasing/order/use history, IP address and information that you provide to our customer service department verbally or in writing.

We may collect your address from the population register or from when you enter it yourself on our website and online store.

Why we process your personal data

We process your personal data for the following purposes on the following lawful bases:

Purchases

We process personal data to manage orders and to send messages regarding delivery status.

This processing is necessary to ensure we fulfil our contract with you.

Customer service issues

We process personal data to manage customer service issues such as questions, complaints and guarantee issues.

Processing takes place to help you with customer service issues, which is our legitimate interest, and to meet our legal obligation in regard to complaints and guarantee issues.

How long personal data is saved

Purchasing and order history is saved for as long as we are obliged to do so in order to comply with the law.

Customer service information relating to purchases and complaints is saved for as long as we are obliged to do so in order to comply with the law. Communication with our customer service department that we are not required to save to comply with the law is deleted within 12 months.

Data for marketing is saved until you ask to no longer receive marketing material or when you have been inactive for five years.

Data for the prevention of improper use and crime is saved for as long as we need to do so to prevent or report crime (e.g. fraud).

Your rights

We respond to your request regarding any of your rights as soon as possible, within one month at the latest.

Where it is permitted by applicable law, we may charge an administrative fee to meet a request as set out below.

Access

You are entitled to receive information about how we process your personal data and a copy of your personal data.

Rectification

You may request that incorrect or incomplete data be rectified.

Erasure

You are entitled to have your personal data erased in the following cases:

  • Your personal data is no longer necessary for the purposes for which it was collected or processed.
  • You have withdrawn your consent for the processing of personal data and there is no other lawful basis for such processing.
  • You have objected to the processing of your personal data that has taken place based on our legitimate interest and your interest overrides this.
  • We have processed personal data unlawfully.
  • Personal data must be erased in order to fulfil a legal obligation.

Restriction of processing

You have the right to demand that the processing of your personal data be restricted in the following cases:

  • You dispute the accuracy of the personal data over a period that allows us to check whether the personal data is correct.
  • We have processed your personal data unlawfully and you object to your personal data being erased and instead request that its use be restricted;
  • You need the personal data to be able to establish, enforce or defend legal claims but we no longer need the personal data for the purposes for which it was processed;
  • You have objected to the processing of your personal data and we assess over a period of time whose legitimate interests take precedence.

You have a right to object to such processing of your personal data that we conduct based on a legitimate interest. Processing ceases in such cases if we do not have a legitimate interest that overrides your interests or if we must continue the processing in order to protect our legal claims.

You have a right to object to processing of your personal data for direct marketing. You may object to direct marketing by contacting our customer service department. If you have made an objection, we will stop processing your personal data for direct marketing.

You have a right to receive the personal data that you have provided us with and that we process on an automated basis on the basis of agreements with you or as a result of your consent, in a structured, standard, machine-readable format.

Our website uses ‘cookies’. The information that is collected and analysed using cookies is used to adapt and streamline our services, our website content, offers and advertisements to website visitors, and to increase security on our website.

In brief, cookies work as follows: All information that needs to remain between the loading of two webpages has to be linked in some way to a particular user. This is done by the storing of a unique key in users’ web browsers.
